Jury gets case in Cosby sex assault trial

Cosby's fate now rests in the hands of the jury, as they begin deliberating.

More than 50 women claim Cosby sexually assaulted them in incidents dating back to the 1960s, when he emerged as a major comedy star. The judge says jurors can continue working as late as they wish, WRAL-TV, Channel 5, reported.

If convicted, Cosby faces up to 10 years in prison for each of three counts of aggravated sexual assault.

He acknowledged that Cosby gave Constand pills, but they were Benadryl and were meant to ease her tension.

McMonagle said that while the comedian had been unfaithful to his wife, he did not commit a crime.

"Drugging somebody and putting them in a position where you can do what you want with them is not romantic. It's criminal", Montgomery County District Attorney Kevin Steele said.

Cosby, who did not testify, has denied all allegations. The jury included two black members.

McMonagle made emotional appeals to the jury, weaving anecdotes about parenting and patriotism as he argued Cosby's prosecution was nonsense driven by lawyers and media attention.

He pointed out that Constand telephoned Cosby dozens of times after the alleged assault.

At the time, Constand was the director of team operations for the Temple University women's basketball team.

"This isn't talking to a trustee. This is talking to a lover", McMonagle said of one phone call that lasted 49 minutes.

"Just tell the truth - what are we doing here?" he continued, one of many exclamations he made in a fiery and at times histrionic closing that lasted almost two hours.

The megastar turned pariah, who has been abandoned by legions of celebrity friends, was on Monday accompanied into court for the first time by his wife of 53 years, Camille, before confirming that he would not testify.

The closing arguments came about quickly Monday after the defense began and closed its case in one morning.

Andrea Constand watched from the front row of the packed courtroom gallery on Monday as Cosby's lawyers spent almost two hours seizing on inconsistencies in her story in a final push for acquittal.

Constand, 44, testified last week that Cosby gave her three blue pills and then penetrated her with her fingers against her will as she lay paralyzed and half-conscious.

Steele, continuing to address defense statements, said a "romantic interlude" did not exist between Constand and Cosby. O'Neill asked Cosby if he discussed the issue with his attorneys and if he understood there is no obligation to testify, as the burden to prove the charges of aggravated indecent sexual assault case lies exclusively with the prosecutors.

Both sides in the Bill Cosby sexual assault trial returned to the courtroom on Monday. His deposition was sealed for years until a judge released parts in 2015 at the request of The Associated Press, prompting a new set of prosecutors to take a fresh look at the case and charge him. McMonagle told the jury that Cosby was nothing worse than a man with infidelity issues who made the world laugh and smile as a comedian. "This is not a civil case about money, money, money". Later, Valentino said in an interview that she was proud to be singled out because she'd helped expose a man she called "the biggest serial rapist in American history". They said that Constand's initial statements to police were full of inconsistencies that undermine the truthfulness of her story.

"This is where all the fancy lawyering can't get you around your own words", he said.

Brian got dirty, constantly victim bashing Andrea, painting her out to be someone who was in a consensual relationship with Cosby and who wasn't honest.

"There are some things in this case that should be fuzzy. Why?"

" 'She'd remember it for the next 365 days and all the days of her life if there were a sexual assault in this case, ' the attorney said".

Cosby also acknowledged that he obtained Quaaludes, a prescription sedative, in the 1970s to give to young women. Legal experts and courtroom observers generally dismissed that suggestion as a bluff, perhaps created to throw prosecutors - who ended with a lot of momentum - off balance.

According to reports in the Washington Post and elsewhere, McMonagle called just one witness to the stand: a detective, who confirmed that Constand had indeed filed a police report after the alleged assault in 2004.

The defense case consisted of a six-minute appearance by a detective, seemingly created to remind jurors that Constand had visited with Cosby at an out-of-state casino and that police knew he had vision problems even then.

The trial comes after repeated efforts by Cosby's lawyers to have the charges thrown out.
