In siding with them, Malloy delivers the tribes their second victory this week - along with a federal appeals court upholding a lower court's dismissal of an MGM suit over search process that led to the East Windsor selection.
The 2nd U.S. Circuit Court of Appeals in Manhattan yesterday ruled that a lower court judge was correct in tossing MGM's suit against the Nutmeg State a year ago.
"I think that that is a pipe dream which MGM gave vision to in the hopes that they would defeat another casino in Connecticut", Malloy said.
"We view today's ruling as nothing more than a matter of timing, and remain undeterred in our goal of having the opportunity to compete in Connecticut", MGM Senior Vice President and Legal Counsel Uri Clinton said.

Legal experts believe that one of the reasons why the Courts threw out MGM's lawsuit was because it was filed too soon. The Connecticut tribes have expressed a desire to have their East Windsor facility open before then.
MGM Resorts could probably end up doing this because one of the statements in the recent ruling says that there is a possibility in the future that the East Windsor casino might cause harm to MGM Springfield.
