The 8-year-old hanged himself with a necktie in the bedroom of his Cincinnati home on January 26.
Attorney's also tell the Associated Press Cornelia Reynolds, the boy's mother, did not learn of the bullying until the attorneys received a copy of a police investigative file that contained an email from a homicide detective to school officials describing the surveillance video.
School officials have said they chose to share the video with police even though the connection between the incident and the boy's death remains unclear.
Shocking surveillance footage from a Cincinnati school shows an 8-year-old boy apparently being pulled headfirst into a restroom wall by a bully - and his classmates kicking and prodding his motionless body.
Following the incident, school officials had called the boy's mother on January 24 and said he had fainted.
According to Reynolds' attorney Jennifer Branch, that video depicts an attack on Taye: After he extended his hand to the second boy, she said, that boy beat him so severely he lost consciousness. Attorneys for the boy's mother say the child lay unconscious for 7 minutes before an assistant principal came to his aid.
"When they tell his mother what happened, they just say that he fainted", Branch said. If the county coroner amends his death certificate, she said she would send the case to the prosecutor's office - if it's determined violence contributed to his death, reports CBS News correspondent Jamie Yuccas.
A Cincinnati homicide detective who has viewed the video said it shows a student in a red and gray coat punching a student wearing glasses in the stomach, sending him to the ground on all fours.
In the video, Gabriel is seen walking into a restroom at Carson Elementary School when he encounters another student.

She picked him up and after vomiting twice at home, she took him to Cincinnati Children's Hospital Medical Center.
Emery said her 9-year-old daughter has also been bullied at the school.
Gabriel only disclosed to his mother that his stomach was hurting.
Leader, the family's other attorney, said Gabriel had no history of mental health issues and described him as a happy-go-lucky kid.
"It is my obligation to make sure that this will never happen again", she said.
"In fact, if his mother had been told that Gabe was assaulted and was unconscious for over seven minutes on the bathroom floor, she would have taken him to the hospital and not let him return to Carson", the lawyers said. If I could, I would give anything to have him back.
