Former Tennessee teacher Tad Cummins' public defender Benjamin Galloway claims his client did not coerce, force or threaten his alleged kidnapping victim, 15-year-old student Elizabeth Thomas.

On Monday, court approved a temporary restraining order prohibiting Thomas' wife from contacting him or speaking out about their daughter's disappearance. He is facing many years of jail time, having been charged after his arrest with the federal crime of transporting a minor across state lines to have sexual intercourse.

Seven weeks before he and the girl left Tennessee to spark what became a nationwide manhunt, Cummins was observed on January 23 by another student at the Culleoka Unit School kissing the 15-year-old alleged victim, according to the complaint sworn out by Columbia, Tenn. police detective Jonathan R. Hardison. Her family has been treading lightly with her ever since.

She said the family is focusing on the positive, as they all need time to heal.

"When you take a child who is underage and you have not gotten permission from their parents, that's kidnapping", Anthony Thomas tells PEOPLE. She looked like she was very worn out, very thin. That really wasn't her. "My child at 15 [years old] is not able to make a decision for herself that she is going to take off somewhere across the country, no matter what world he lives in". "She may not be exactly ... the person she was, because there's a lot of experiences she's had".

A California man who tipped off authorities to the location of a missing 15-year-old Middle Tennessee girl and the man police say kidnapped her will be awarded $10,000 on Friday for his involvement in the case that garnered national attention.

Before disappearing, Cummins was investigated by the school system when another student reported seeing the then-married teacher kiss Thomas at the Culleoka Unit School.

Tad Cummins, 50, faces federal and state charges for his role in the alleged abduction.

He and Thomas eluded authorities for more than a month, switching license plates, changing their physical appearances and using only cash to survive. "She is being evaluated and treated by mental health experts specializing in trauma", Whatley said. In furtherance of this plan, the defendant procured a small watercraft and conducted a test run to cross into Mexico across the water from San Diego.
