J&K: Opposition, industry bodies oppose PDP-BJP support for implementation of GST

Addressing the Provincial Committee Meeting, Senior NC leader and North Zone President, Mr. Mohammad Akbar Lone said the State Government was dishonest in trying to peddle lies and half-truths on the GST issue in an effort to mislead the people of the State.

The bone of contention in the state is the constitutional amendment 101.

The Jammu Chamber of Commerce and Industry (JCCI) today extended support beyond what was unexpected by vouching for strengthening of Article 370 that grants special status to J&K while demanding that "special powers with the J&K Government to tax or review should not be surrendered to the GST council". "Instead of the tax share devolving to the s ate from the centre, let us enact our own tax laws so that we give centre its share of taxes collected by the state government", he said. "We would also organize protest march from Press Enclave to Secretariat on Monday to lodge our protest against the implementation of GST".

The government has called for a special session to pass GST law from June 17, which is likely to be deferred even as the finance minister has assured that the GST in modified form will not impact the special status of the state.

If the tax is not rolled out in the state, it would mean the people of the state would have pay double tax and wouldn't get the benefit of the input tax credit. According to him, the constitutional amendment 101 doesn't apply to the state and the special assembly session will take a final call over the issue.

It said implementation of the said GST law shall deprive the state of its financial autonomy and its powers to legislate on the financial matters of the state.

NC leader Abdur Rahim Rather said implementing GST at the cost of the state's financial autonomy is unacceptable to his party and the state's people.

State Congress Vice-President GN Monga has said the state shall have its own GST Council and it shouldn't become subservient to the tax rate which was determined for the entire country. It added that both chambers later had a meeting with Finance Minister Haseeb A Drabu where many other prominent business associations from Kashmir were also present and expressed concern regarding the GST. "We do not oppose the new taxation regime but we will not allow the implementation of the 101st Amendment of the Constitution of India in its original form to J&K come what may", said Rather. The GST Council can shoot down any proposal from the State on Goods and Services and this is going to happen to Jammu and Kashmir.
