Di Modica's bull sculpture was initially installed in front of the New York Stock Exchange as an example of guerrilla art.
"The issue remains: How they have placed (the girl) in relation to the bull changed the bull and its message".
State Street also created SHE, an index designed to track gender diversity in corporations.
Arturo Di Modica, the artist responsible for the iconic bronze bull statue on Wall Street, is challenging the city's installment of the fearless girl statue without his permission.
Mayor Bill de Blasio said men who don't like women taking up space "are exactly why we need 'Fearless Girl"'.
"It's negative", Arturo Di Modica said of the girl's juxtaposition to the popular bull statue.
On the eve of International Women's Day, Kristen Visbal's sculpture was placed on a traffic island near Wall Street to make a point, which is that there's a shortage of women on the boards of the largest USA corporations.
But Di Modica's lawyers questioned whether the city should have granted the permit and said the firm behind it was using public property for commercial advertising.

Earlier, Barcelona had registered a record-breaking achievement by overturning a 0-4 deficit from the first leg of their last-16 tie against PSG.
Di Modica isn't so quick to jump on the bandwagon.
This defiant little bronze statue was temporarily installed as a symbol of equality and pressure for big investment firms to add more women to their boards.
It's a battle of two sculptures, and two ideals: "Charging Bull", a 7,100-pound symbol of brash financial optimism, and "Fearless Girl", a four-foot emblem of female empowerment.
The artist said he would hold a news conference on Wednesday with his attorney Norman Siegel to explain how he plans to challenge city officials who extended the bronze's girl permit.
Di Modica's lawyer, Steven J. Hyman of McLaughlin & Stern LLP, told Bloomberg BNA said that he hopes that the dispute can be settled without his having to file a lawsuit. The girl quickly became an online sensation, earning praise from Chelsea Clinton and actress Jessica Chastain and drawing its own swarm of women and girls who felt inspired.
"The bull is handsome, it's a stunning piece of art", Visbal told the New York Post. He called it copyright infringement, and said he's considering filing suit if the girl sculpture isn't moved.
"I love Charging Bull", Kristen Visbal told the Associated Press last month. Di Modica meant his bull to stand alone-now, it's as if Visbal and New York City have made a solo piece a diptych without his consent.
