After reports surfaced yesterday that he could go back to prison, it looks like DMX caught a break from a judge, as he has been sentenced to house arrest. He also confirmed TMZ's report that X tested positive for cocaine and marijuana. According to TMZ, the "X Gon' Give It To Ya" rapper reportedly showed up 30 minutes late to his bail bond hearing, and failed four drug tests, but the judge chose to show some mercy.
In July, the NY native whose birth name is Earl Simmons, was arrested on suspicion of tax evasion for allegedly owing the IRS more than $1 million in back taxes.
On Friday morning, DMX was already on thin ice with a judge as he showed up 30 minutes late to his bail bond hearing with lawyer Murray Richman.
"He does have a rap sheet that does suggest more than a passing acquaintance with illegal drugs and more than a passing acquaintance with hand guns", Rakoff said. He was sporting a Def Leppard t-shirt.

In a letter that the attorney for the board of commissioners wrote to Live Nation, they ask that the show be cancelled. Fulton County officials were attempting to ban the rapper from performing a concert there later this month.
The judge could easily have thrown the rapper in jail, but showed him mercy by putting him on house arrest.
Rakoff dismissed DMX with a warning.
When a cameraman asked how he planned to celebrate the judge's decision to spare him jail time, he replied, "That's a celebration right there, just being in there and being able to walk out".
