About an hour into the sixth day of deliberations, Judge Steven O'Neill declared that the jury of seven men and five women were hopelessly deadlocked in a legal battle closely watched by the public as well as dozens of women who have accused Cosby of similar misconduct in the past. If found guilty, he could face up to 10 years in prison for each charge.
"He thought he could bury us", accuser Linda Kirkpatrick said of Cosby outside the courtroom in Norristown, Pennsylvania.
"We commend those prosecutors", they continued, "who raised awareness that one of the hallmarks of drug related sexual assaults is the affect the drug has on the victim's memory and ability to recall and were nonetheless willing to present this evidence to the jury".
As previously reported, Cosby's team initially requested a mistrial midweek, after jurors hit their first road block, following at least 12-hours of deliberations.
Prosecutors called 12 witnesses, including Constand, over a week of testimony but presented nearly no forensic evidence.
The 79-year-old Cosby is accused of drugging and molesting a Temple University employee in 2004 at his home near Philadelphia.
In the deposition, he spoke in a tiresome, lugubrious manner about sex, describing Constand reaching her "sexual moment".

He also said the pills he gave her were over-the-counter Benadryl, which he admitted can cause sleepiness. "I AM A THRIVER!" she said in a statement.
Cosby has continued, through his representatives, to deny that he committed any sexual assaults - admitting to infidelity but maintaining that all the sexual contact was consensual. "It was too late for her to sue for rape or for drugging, but once he, through his representatives, called her a liar, she had a fresh claim for defamation and that's the lawsuit that we filed".
A decade later, another district attorney reopened the investigation after Cosby's lurid testimony about drugs and sex became public, and dozens of women came forward against one of the most beloved stars in all of show business. He ordered them to keep trying but declared a mistrial June 17, the sixth day of their deliberations.
