Trump says travel ban ruling comes at 'dangerous time'

President Donald Trump on Tuesday morning denounced a federal court ruling against his travel ban, his latest criticism of the judiciary in the ongoing legal battle over his controversial executive order.

The president tweeted early Tuesday, "well, as predicted, the 9th Circuit did it again - Ruled against the TRAVEL BAN at such a unsafe time in the history of our country. S.C".

On Monday, the San Francisco-based 9th U.S. Circuit Court of Appeals became the second federal appeals court to reject the Republican Trump administration's bid to undo a Hawaii federal judge's decision that blocked the temporary travel ban in a dispute headed to the U.S. Supreme Court.

Hawaii Attorney General Doug Chin, who sued to stop the travel ban, said the 9th Circuit ruling "really shows that we have three branches of government and that there are checks and balances".

"National security is not a "talismanic incantation" that, once invoked, can support any and all exercise of executive power.(The law) requires that the president exercise his authority only after meeting the precondition of finding that entry of an alien or class of aliens would be detrimental to the interests of the United States".

The ruling said the president has violated USA immigration law by discriminating against people based on their nationalities and by failing to demonstrate that their entry into the country would hurt American interests. In a series of tweets following the London attack, the president referred to his order as a "travel ban" and insisted it was necessary to keep the US safe.

"We continue to be confident that the president's executive order to protect this country is fully lawful and ultimately will be upheld by the Supreme Court", he added.

The judges pointed to a June 5 tweet by Trump saying the order was aimed at "dangerous countries".

That issue wasn't before the 4th Circuit, because in the Maryland case it considered, the lower court judge had not struck down the refugee program's suspension.

The administration has asked the Supreme Court to immediately reinstate the ban on travelers. The justices have a range of options in front of them.

The ruling Monday from a unanimous three-judge panel of the 9th U.S. Circuit Court of Appeals deals the administration another legal defeat as the Supreme Court considers a separate case on the issue.

"They don't need to psychoanalyze the president", he said.
